Terms and Conditions for DrumsFit

These Terms and Conditions ("Terms") govern your use of the DrumsFit mobile application for iPhone and Android (the "App"), provided by David Lino (the "Developer", "we", "us", or "our"). By downloading and using the App, you agree to these Terms.

1. The Service

The App is a daily drum practice tool. It builds a short workout each day, plays a metronome, and keeps your progress on your device. We offer the App in the plans below. We may change, add, or remove features in any plan over time.

Free use

• Free workouts. Every drummer gets 5 free workouts with every feature. A free workout is used on each calendar day on which you complete at least one set, other than the warm-up. More workouts on the same day do not use another free workout.
• After the free workouts. When you have used your 5 free workouts and have no paid plan, the App no longer starts workouts, opens exercise previews, or changes the day's workout. The metronome, your history, your settings, and the data export stay free.
• Keeping count. The App counts your free workouts from the history on your device. If you delete the App, its history and the count are deleted with it.

Paid plans

• Monthly or Yearly subscription. Full access to every feature while the subscription is active.
• Founder Pass (one-time purchase). Full access with no end date. It includes new exercises and every future feature that works offline. It does not include future features that need ongoing server costs. The Founder Pass is a limited offer, and we may stop selling it at any time.

If we change or remove a feature for subscribers, the same change applies to Founder Pass owners.

2. In-App Purchases and Subscriptions

• Payment. The Apple App Store or Google Play processes all payments. We use the third-party service RevenueCat to manage purchase and subscription status. RevenueCat does not process payments. All payments are subject to the terms of the store you buy from.
• Prices. The store shows the price of each plan in your local currency before you buy. We may change prices for future purchases. The store tells you about price changes for active subscriptions according to its own rules.
• Auto-Renewal. Subscriptions renew automatically for the same period unless you cancel at least 24 hours before the end of the current period. You can manage and cancel your subscription in your App Store or Google Play account settings.
• Buying the Founder Pass while you subscribe. If you buy the Founder Pass while you have a subscription, the store does not cancel the subscription for you. You must cancel it in your store account settings to stop further charges.
• Lapse of Subscription. If your subscription ends, you lose full access. Your 5 free workouts do not start again. All your history stays on your device, and you get full access back as soon as you buy a plan again.
• Refunds. Apple and Google handle all refunds according to their own policies. For Apple, request a refund at reportaproblem.apple.com. We cannot issue refunds ourselves.
• Family Sharing. Our plans are not available through Family Sharing. Each purchase is for the account that made it.
• Restoring purchases. If you change or reset your device, use "Restore purchases" in the App to get back the plans you own.

3. Your Content

You own all the data you create in the App. It is stored on your device. We have no access to it unless you send it to us, for example with "Export my data".

4. Health and Safety

Drumming is physical activity. Stop if you feel pain, and protect your hearing. The App gives practice suggestions, not medical advice.

5. License to Use the App

We grant you a limited, non-transferable, revocable license to use the App for your personal, non-commercial purposes, subject to these Terms.

6. Prohibited Conduct

You agree not to:

• Reverse engineer, decompile, or otherwise attempt to discover the source code of the App.
• Use the App for any illegal or unauthorized purpose.
• Sell, rent, or lease your access to the App.
• Attempt to bypass the free workout limit or the checks that unlock paid plans.

7. Termination

We may end or suspend your access to the App at any time, without notice, if you breach these Terms. You can end this agreement at any time by deleting the App and cancelling any subscription you have.

8. Disclaimer of Warranties

The App is provided "as is" and "as available," without warranties of any kind, express or implied. We do not warrant that the App will be error-free or uninterrupted.

9. Limitation of Liability

To the fullest extent permitted by law, the Developer is not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, that result from your use of the App.

10. Changes to These Terms

We may update these Terms, for example when we change our plans. We will show the new effective date at the top of this page. If you keep using the App after a change, you accept the updated Terms.
